سياسة الخصوصية

توضح هذه السياسة كيف تقوم JAMRAH AND OUD ("نحن" أو "المتجر") بجمع بياناتكم الشخصية واستخدامها ومشاركتها وحمايتها عند زيارة موقع www.jamrahoud.ae أو تقديم طلب أو التواصل معنا. باستخدامكم للموقع فإنكم توافقون على الممارسات الموضحة أدناه.

يُدار المتجر عبر منصة Shopify، ونلتزم بالمرسوم بقانون اتحادي رقم (45) لسنة 2021 بشأن حماية البيانات الشخصية في دولة الإمارات العربية المتحدة وبالقوانين المعمول بها.

1. البيانات التي نجمعها

بيانات تقدمونها لنا مباشرة: الاسم، البريد الإلكتروني، رقم الهاتف / واتساب، عنوان الشحن والفوترة، محتوى الطلب، ملاحظات التوصيل، بيانات حساب العميل إن أنشأتم حساباً، ورسائلكم عبر نموذج التواصل أو البريد الإلكتروني أو واتساب، والبريد الإلكتروني عند الاشتراك في النشرة البريدية.

بيانات تُجمع تلقائياً: عنوان IP، نوع الجهاز والمتصفح ونظام التشغيل، اللغة، الصفحات التي تمت زيارتها، المنتجات التي تم عرضها، مصدر الزيارة، وأوقات التصفح — وذلك عبر ملفات تعريف الارتباط والتقنيات المشابهة.

بيانات من أطراف أخرى: معلومات من Shopify ومزودي الدفع وشركات الشحن ومنصات التواصل الاجتماعي وأدوات التحليلات، بالقدر اللازم لإتمام الطلب وتقديم الخدمة.

لا نجمع عمداً بيانات حساسة (كالبيانات الصحية أو الدينية أو البيومترية)، ولا نطلب منكم تزويدنا بها.

2. بيانات الدفع

لا نقوم بجمع أو تخزين بيانات بطاقتكم البنكية. تتم معالجة المدفوعات بالكامل لدى مزودي خدمات دفع خارجيين معتمدين من خلال اتصال مشفّر، ومنهم Tap Payments (البطاقات، مدى، Apple Pay وغيرها) وPayPal، إضافة إلى خيار الدفع عند الاستلام. ولا يصلنا من هذه الجهات سوى ما يلزم لتأكيد نجاح العملية (مثل حالة العملية وآخر أربعة أرقام من البطاقة ونوعها). تخضع معالجة بياناتكم لدى هذه الجهات لسياسات الخصوصية الخاصة بها.

3. أغراض استخدام البيانات

  • معالجة الطلبات والمدفوعات وإصدار الفواتير وتنفيذ الشحن والتسليم.
  • التواصل معكم بشأن الطلب أو الاستفسارات أو طلبات الإرجاع والاسترداد.
  • إدارة حساب العميل عند إنشائه.
  • منع الاحتيال وحماية المتجر والعملاء وتأمين المعاملات.
  • إرسال العروض والمستجدات التسويقية عند اشتراككم أو موافقتكم، مع إمكانية إلغاء الاشتراك في أي وقت.
  • تحسين المنتجات والموقع وتجربة التسوق عبر تحليل الاستخدام بصورة إجمالية.
  • الوفاء بالالتزامات القانونية والمحاسبية والضريبية في دولة الإمارات العربية المتحدة.

4. الأساس القانوني للمعالجة

نعالج بياناتكم استناداً إلى تنفيذ العقد المبرم معكم عند الشراء، أو موافقتكم (كالتسويق وملفات تعريف الارتباط الاختيارية)، أو التزاماتنا القانونية، أو مصلحتنا المشروعة في تشغيل المتجر بأمان ومنع الاحتيال.

5. مشاركة البيانات

نحن لا نبيع بياناتكم الشخصية ولا نؤجرها لأي جهة. ونشاركها فقط بالقدر اللازم مع:

  • Shopify — منصة التجارة الإلكترونية والاستضافة التي يعمل عليها المتجر.
  • مزودي خدمات الدفع — مثل Tap Payments وPayPal، لمعالجة المدفوعات والمبالغ المستردة.
  • شركات الشحن والتوصيل — لتسليم الطلبات (الاسم، العنوان، رقم الهاتف).
  • مزودي خدمات تقنية وتحليلية وتسويقية — للبريد الإلكتروني والتحليلات ودعم العملاء، ضمن نطاق الخدمة المقدمة لنا.
  • الجهات الرسمية — عند وجود التزام قانوني أو أمر من جهة مختصة أو لحماية حقوقنا.

نلزم مزودي الخدمات بالمحافظة على سرية البيانات واستخدامها فقط للأغراض المتفق عليها.

6. ملفات تعريف الارتباط (Cookies)

يستخدم الموقع ملفات تعريف الارتباط لتشغيل السلة وتسجيل الدخول وحفظ التفضيلات (وهي ضرورية لعمل الموقع)، ولقياس الأداء وتحسين تجربة التصفح ولأغراض تسويقية. يمكنكم ضبط أو حظر ملفات تعريف الارتباط من إعدادات المتصفح، مع ملاحظة أن تعطيل الملفات الضرورية قد يمنع إتمام الشراء.

7. نقل البيانات خارج الدولة

نظراً لاعتماد المتجر على مزودي خدمات عالميين (مثل Shopify ومزودي الدفع)، قد تُخزّن بياناتكم أو تُعالج على خوادم خارج دولة الإمارات العربية المتحدة. وفي هذه الحالات نحرص على أن يوفر المزود مستوى حماية مناسباً وضمانات تعاقدية تتوافق مع القوانين المعمول بها.

8. مدة الاحتفاظ بالبيانات

نحتفظ ببيانات الطلبات والفواتير للمدة التي تتطلبها الأنظمة المحاسبية والضريبية في دولة الإمارات، وببيانات الحساب طالما ظل الحساب فعالاً، وببيانات التسويق حتى إلغاء الاشتراك. وبعد انتهاء الحاجة تُحذف البيانات أو تُجعل مجهولة الهوية.

9. أمن المعلومات

يعمل الموقع عبر اتصال مشفّر (SSL/HTTPS)، ونطبّق ضوابط تقنية وتنظيمية معقولة لحماية البيانات من الوصول أو الإفصاح غير المصرح به. ومع ذلك لا يمكن ضمان أمان أي وسيلة نقل عبر الإنترنت بنسبة 100%.

10. حقوقكم

وفقاً لقانون حماية البيانات الشخصية في دولة الإمارات، يحق لكم: الاطلاع على بياناتكم والحصول على نسخة منها، وتصحيحها أو تحديثها، وطلب حذفها، وتقييد أو الاعتراض على معالجتها، وسحب موافقتكم على التسويق في أي وقت، وطلب نقل بياناتكم. لممارسة أي من هذه الحقوق راسلونا على support@jamrahoud.ae، وسنرد خلال المدة التي يحددها القانون. كما يحق لكم تقديم شكوى إلى مكتب إدارة البيانات في دولة الإمارات العربية المتحدة.

11. خصوصية الأطفال

الموقع مخصص للبالغين، ولا نجمع عن قصد بيانات من هم دون 18 عاماً. وإذا تبيّن لنا خلاف ذلك نقوم بحذف البيانات.

12. الروابط الخارجية

قد يحتوي الموقع على روابط لمواقع أو منصات أخرى (مثل حسابات التواصل الاجتماعي). ولا نتحمل مسؤولية ممارسات الخصوصية لدى تلك الجهات، وننصح بمراجعة سياساتها.

13. تحديث السياسة

قد نقوم بتحديث هذه السياسة من وقت لآخر لأسباب تشغيلية أو قانونية أو تنظيمية، ويُنشر الإصدار المحدّث على هذه الصفحة مع تعديل تاريخ آخر تحديث.

This policy explains how JAMRAH AND OUD ("we", "us", or "the store") collects, uses, shares, and protects your personal data when you visit www.jamrahoud.ae, place an order, or contact us. By using the website, you agree to the practices described below.

The store runs on the Shopify platform, and we comply with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data and other applicable laws.

1. Information We Collect

Information you provide directly: name, email address, phone / WhatsApp number, shipping and billing address, order contents, delivery notes, customer account details if you create an account, messages you send through the contact form, email, or WhatsApp, and your email address if you subscribe to our newsletter.

Information collected automatically: IP address, device, browser and operating system, language, pages visited, products viewed, referral source, and browsing times — collected through cookies and similar technologies.

Information from third parties: data from Shopify, payment providers, shipping companies, social media platforms, and analytics tools, to the extent needed to complete your order and provide our services.

We do not knowingly collect sensitive data (such as health, religious, or biometric data), and we never ask you to provide it.

2. Payment Data

We do not collect or store your card details. Payments are processed entirely by accredited third-party payment providers over an encrypted connection, including Tap Payments (cards, Mada, Apple Pay, and others) and PayPal, alongside a cash-on-delivery option. We receive only what is needed to confirm a transaction (such as its status, the card type, and the last four digits). Their processing of your data is governed by their own privacy policies.

3. How We Use Your Information

  • Processing orders and payments, issuing invoices, and arranging shipping and delivery.
  • Communicating with you about your order, enquiries, returns, or refunds.
  • Managing your customer account, if you create one.
  • Preventing fraud and protecting the store, our customers, and transaction security.
  • Sending offers and marketing updates where you have subscribed or consented — you may unsubscribe at any time.
  • Improving our products, website, and shopping experience through aggregated usage analysis.
  • Meeting our legal, accounting, and tax obligations in the United Arab Emirates.

4. Legal Basis for Processing

We process your data to perform the contract formed when you purchase from us, on the basis of your consent (for marketing and optional cookies), to comply with our legal obligations, or for our legitimate interest in operating the store securely and preventing fraud.

5. Sharing Your Information

We do not sell or rent your personal data to anyone. We share it only as necessary with:

  • Shopify — the e-commerce and hosting platform the store runs on.
  • Payment providers — such as Tap Payments and PayPal, to process payments and refunds.
  • Shipping and delivery companies — to deliver your order (name, address, phone number).
  • Technology, analytics, and marketing service providers — for email, analytics, and customer support, limited to the service they provide to us.
  • Authorities — where required by law, by an order from a competent authority, or to protect our rights.

We require our service providers to keep your data confidential and to use it only for the agreed purposes.

6. Cookies

The website uses cookies to operate the cart, sign-in, and saved preferences (these are essential to the site working), as well as to measure performance, improve the browsing experience, and support marketing. You can manage or block cookies in your browser settings, though disabling essential cookies may prevent you from completing a purchase.

7. International Data Transfers

Because the store relies on global service providers (such as Shopify and payment providers), your data may be stored or processed on servers outside the United Arab Emirates. In those cases we take care that the provider offers an adequate level of protection and contractual safeguards consistent with applicable law.

8. Data Retention

We retain order and invoice data for as long as UAE accounting and tax rules require, account data for as long as your account remains active, and marketing data until you unsubscribe. Once no longer needed, data is deleted or anonymised.

9. Data Security

The website operates over an encrypted connection (SSL/HTTPS), and we apply reasonable technical and organisational measures to protect your data against unauthorised access or disclosure. However, no method of transmission over the internet can be guaranteed to be 100% secure.

10. Your Rights

Under UAE personal data protection law, you have the right to access your data and obtain a copy of it, to correct or update it, to request its deletion, to restrict or object to its processing, to withdraw your marketing consent at any time, and to request the transfer of your data. To exercise any of these rights, email us at support@jamrahoud.ae and we will respond within the period set by law. You also have the right to lodge a complaint with the UAE Data Office.

11. Children's Privacy

The website is intended for adults. We do not knowingly collect data from anyone under 18 years of age, and we delete such data if we become aware of it.

12. External Links

The website may contain links to other sites or platforms (such as our social media accounts). We are not responsible for their privacy practices, and we recommend reviewing their policies.

13. Changes to This Policy

We may update this policy from time to time for operational, legal, or regulatory reasons. The updated version will be posted on this page with a revised "Last updated" date.
